The websites, mobile applications and services provided by BeneSys are intended for use by participants in its client trust funds, located in the United States and Canada and are not intended for use by individuals located elsewhere, including in the European Union or United Kingdom. By providing personal information on BeneSys’s websites and mobile applications, you are agreeing to the transfer, storage and processing of information in the United States.

Collection of your Personal Information

BeneSys collects personal information of participants enrolled in or potentially eligible for benefits from our client’s benefit plans. This information includes your name, gender, date of birth, Social Security number, home and work address, email address and telephone number. BeneSys may collect this information directly from you when you enroll in a benefit plan or from your employer or union. If your dependents are, or may become, eligible for benefits, BeneSys may also collect their personal information. BeneSys uses this personal information to administer pension, health and other benefit plans you may qualify for through your employment.

When you visit BeneSys’s websites, including benefit plan sites hosted by BeneSys, BeneSys may collect anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests and favorites. This information is used for market research and to help BeneSys report user statistics to its client trust funds. BeneSys’s websites will generally recognize “Do Not Track” computer coding used by some internet browsers to indicate when a visitor prefers not to be monitored.

There is also information about your computer hardware and software that is automatically collected by the BeneSys websites and mobile applications. This information may include your IP address, browser type, domain names, access times and referring web site addresses. This information is used for the operation of the service, to maintain quality of the service, for security purposes and to provide general statistics regarding use of the BeneSys websites and or mobile applications.

We encourage you to review the privacy statements of websites you choose to link to directly from a BeneSys website or mobile application so that you can understand how those websites collect, use and share your information. BeneSys is not responsible for the privacy statements or other content on websites outside of the websites and mobile applications maintained and hosted by BeneSys.

Use of your Personal Information

BeneSys collects and uses your personal information to administer benefit plans on behalf of its client trust funds. Your personal information may be shared with the trustees of your benefit plans and other service providers engaged by the trustees to assist in the administration of your benefit plan. BeneSys may also share your personal information with its subcontractors who assist in the fulfillment of its obligations to its client trust funds.

BeneSys does not sell, rent or lease your personal information. All third parties engaged by BeneSys to assist with the administration of your benefit plan are prohibited from using your personal information except to provide subcontracted services are required to maintain the confidentiality of your information. BeneSys may use your email address to contact you regarding your benefits but will not send you promotional or marketing emails.

Except as disclosed in this Statement, BeneSys does not use or disclose sensitive personal information without your consent. BeneSys will keep track of the websites and pages you visit while using its websites and mobile application, in order to determine which features or pages are the most popular. This data may be used to deliver customized content to customers whose behavior indicates that they are interested in a subject area.

BeneSys will disclose your personal information without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on BeneSys or its client trust funds; (b) protect and defend BeneSys’s rights or property in its websites and mobile application and, (c) act under exigent circumstances to protect the personal safety of users of its websites and mobile applications, or the public.

BeneSys uses “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your computer by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. You can accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the mobile application and/or portals.

Security of your Personal Information

BeneSys strives to secure your personal information from unauthorized access, use or disclosure. We secure the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other web sites, it is protected using encryption, such as the Secure Socket Layer (SSL). No entity, including BeneSys, can guarantee with absolute certainty that personal information will not be compromised in a security incident. In the event of a security incident compromising your personal information, BeneSys will work with your trust fund to inform you promptly of the event.

If required by law, upon request, BeneSys will grant you reasonable access to the personal information that it maintains about you. You may request access to your personal information by contacting us at the address below.

If required by law, upon request, you may request corrections to your personal information by contacting BeneSys at the address below.

 Deletion of your Personal Information

The California Consumer Privacy Act of 2018 permits California residents to request that a business delete the personal information collected about them, subject to exceptions, including business necessity. You may request that BeneSys delete your personal information by contacting us at the address below. However, your right to such deletion may be limited by applicable law. For example, BeneSys is permitted to keep your personal information as needed to comply with its legal obligations, to resolve disputes and to enforce any of its agreements.

BeneSys will occasionally update this Statement to reflect company and customer feedback. We encourage you to periodically review this Statement to be informed of how we are protecting your information.
